Overview
Welcome to Gluten Tag! The terms "we", "us" and "our" refer to Gluten Tag (CVR 44778939), a sole proprietorship registered in Denmark and operated by Josefina Orellana. Gluten Tag operates this online store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Gluten Tag is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Section 1 — Access and account
By agreeing to these Terms of Service, you confirm that you are at least 18 years old, the age of majority in Denmark.
To use the Services, including browsing our online store or purchasing any of our products, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current and complete.
You are solely responsible for maintaining the security of your account credentials and for all activity in your account.
Section 2 — Our products
All products sold by Gluten Tag are 100% gluten free baked goods, prepared in a dedicated gluten free kitchen.
While we work exclusively with gluten free certified ingredients and our kitchen does not handle wheat or any gluten containing flour, we cannot guarantee that our products are free from other allergens. Each product page includes a full ingredient list. If you have a specific allergy or medical condition beyond gluten intolerance, please review ingredients carefully and contact us before ordering.
We have made every effort to provide an accurate representation of our products in our online store. However, the appearance of finished baked goods may slightly differ from images shown, as each product is handmade and small variations are part of our artisan process.
All product descriptions, availability, and offerings are subject to change at any time without notice at our sole discretion.
Section 3 — Orders
When you place an order, you are making an offer to purchase. Gluten Tag reserves the right to accept or decline your order at its discretion. Your order is not accepted until Gluten Tag confirms acceptance.
Most orders require at least 48 hours notice. Layer cakes, custom cakes and event orders require at least 10 days notice.
Your purchases are subject to return, refund or cancellation solely in accordance with our Refund and Return Policy.
Products purchased from Gluten Tag are intended for personal consumption only. Resale of our products through any channel, including online marketplaces, retail, or wholesale distribution, is not permitted without prior written agreement. Section 4 — Prices and billing
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation email. Unless otherwise stated, prices include applicable Danish VAT where required.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases.
Section 5 — Pickup and delivery
Orders can be picked up at our kitchen at Lygten 59, 2. th, 2400 København NV during scheduled pickup hours, or delivered within Copenhagen by arrangement.
Delivery times are estimates only. We are not responsible for delays caused by events outside our reasonable control.
For perishable products, it is the customer's responsibility to pick up the order or be available to receive delivery at the agreed time. Products left unclaimed after the agreed time cannot be refunded.
Section 6 — Intellectual property
Our Services, including all trademarks, brand elements, text, images, photography, graphics, and the design and arrangement thereof, are owned by Gluten Tag and are protected by Danish and international copyright and intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, republish, or use any material on the Services without our prior written consent.
The "Gluten Tag" name, logo, and visual identity are trademarks of Gluten Tag. Shopify's name, logo, and brand elements are trademarks of Shopify.
Section 7 — Third party links
The Services may contain links to websites operated by third parties. We are not responsible for the content, accuracy or practices of any third party website. If you choose to access these sites, you do so at your own risk.
Section 8 — Relationship with Shopify
Gluten Tag is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Gluten Tag. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and Gluten Tag, including any injury, damage, or loss resulting from purchased products and services. You hereby release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Gluten Tag.
Section 9 — Privacy
All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read and accept these privacy policies.
Section 10 — Feedback
If you submit ideas, suggestions, feedback, reviews, or other content, you grant us a perpetual, worldwide, royalty-free license to use that feedback for any purpose, including operating and promoting the Services.
We are under no obligation to keep feedback confidential, pay compensation for it, or respond to it.

This section does not exclude or limit any consumer rights you may have under mandatory Danish or EU consumer protection law.
Section 14 — Limitation of liability
To the fullest extent permitted by Danish law, Gluten Tag shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Services or any products purchased through the Services. Our total liability for any direct damages shall not exceed the amount paid by you for the products giving rise to the claim.
Nothing in this section limits liability that cannot be excluded under mandatory consumer protection law.
Section 15 — Termination
We may terminate or restrict your access to the Services at any time at our discretion, without notice, if we believe you have violated these Terms.
Sections relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, and Governing Law shall survive any termination.
Section 16 — Governing law
These Terms of Service shall be governed by and construed in accordance with the laws of Denmark. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Danish courts, without prejudice to mandatory consumer rights that allow consumers to bring proceedings in their country of residence within the EU.
